농지 전수조사가 진행되는 가운데 투기성 농지를 가려내면서 고령농과 임차농 등 실제 농업인의 피해를 최소화해야 한다는 요구가 나왔다. 묘지로 사용하는 농지도 단순 휴경과 구분해 농지전용 이력과 분묘 설치 경위를 확인해야 한다.

지난 29일 전남청사에서 열린 긴급토론회 참석자들은 농지 투기와 불법 소유를 바로잡는 취지에 공감하면서도, 일률적인 단속이 임차농의 경작을 위협할 수 있다며 보호 대책을 요구했다.

농지 전수조사는 소유자와 실제 경작자, 임대차 관계, 휴경 여부, 불법전용 등을 확인하는 조사다. 올해는 1996년 농지법 시행 이후 취득한 농지를 중심으로 기본조사에 이어 현장 심층조사가 진행되고 있다.

휴경지는 경작 중단 사유를 살펴야 한다. 자연재해·농지개량·질병 등 법령상 정당한 사유가 인정되는 경우와 장기간 무단 방치한 경우는 처리 기준이 다르다. 임대농지도 상속농지 등 법에서 허용하는 임대인지, 실제 누가 농사를 짓는지를 함께 확인해야 한다.

정부는 9월 21일 명백한 투기와 중대한 불법전용은 법에 따라 조치하되, 농촌의 관행적 위반은 자진 정비와 농지은행 위탁 등을 통해 정상화하는 방향을 발표했다. 임대차 특별 정비기간은 11월 15일까지 연장했다.

묘지로 사용하는 농지는 별도의 검토가 필요하다. 농지에 허가 없이 분묘를 조성했다면 불법전용으로 원상회복 대상이 될 수 있다. 다만 오래된 조상 묘는 설치 당시 법령과 허가 이력, 토지 사용 관계를 확인해야 하며, 조사에서 발견됐다는 이유만으로 즉시 이장하는 것은 아니다. 분묘 이전에는 장사법상 개장 절차와 연고자 관계도 검토해야 한다.

정부가 추진하는 사후 양성화 역시 기존 묘지를 모두 합법화한다는 의미는 아니다.

발표된 방안은 특별조치법 제정과 세부 요건 마련이 필요한 단계로, 묘지 사용 농지의 적용 여부는 개별 확인이 필요하다.

As the nationwide farmland survey proceeds, calls are growing to identify speculative landholdings while minimizing harm to elderly farmers, tenant farmers and others actively engaged in agriculture. Farmland used for burial sites also requires a separate review of land conversion records and the circumstances under which graves were established, rather than being treated simply as fallow land.
At an emergency forum held at the Jeonnam Government Office on September 29, participants supported the goal of addressing farmland speculation and unlawful ownership. However, they warned that indiscriminate enforcement could threaten tenant farmers’ ability to continue farming and called for protective measures.
The survey examines land ownership, actual cultivators, lease arrangements, fallow status and unauthorized conversion to non-agricultural uses. This year, it focuses on farmland acquired after the Farmland Act took effect in 1996. Following the initial assessment, in-depth field investigations are now underway.
For fallow land, investigators must examine why cultivation stopped. Cases involving legally recognized reasons, such as natural disasters, farmland improvement or illness, are treated differently from prolonged abandonment without justification. For leased farmland, authorities must determine whether the lease falls within a legally permitted category, including certain inherited farmland, and identify who actually cultivates the land.
On September 21, the government announced that clear cases of speculation and serious unauthorized land conversion would be addressed under the law. Customary violations arising from rural practices would be regularized through voluntary corrective measures and arrangements such as entrusting land to the Farmland Bank. The special period for regularizing farmland leases has been extended to November 15.
Farmland used for burial sites requires a separate assessment. Graves established without the required farmland conversion authorization may constitute unauthorized conversion and could be subject to an order to restore the land. However, longstanding ancestral graves require a review of the laws applicable when they were established, authorization records and land-use rights. Their discovery during the survey does not automatically require immediate relocation. Any relocation must also take account of the procedures under the Act on Funeral Services, Etc. and the rights and status of relatives or other responsible parties.
The government’s proposed retrospective legalization measures do not mean that all existing burial sites will become lawful.
The announced measures still require special legislation and detailed eligibility criteria. Whether they apply to farmland used for burial sites must therefore be determined on a case-by-case basis.
